This Agreement is entered into by Knight Visuals Photography Studio (hereafter referred to as “Knight Visuals”) and the Client. By booking photography services with Knight Visuals, the Client agrees to the terms outlined below.

1. Booking & Deposit

• A 70% booking deposit of the total session fee is required to secure your booking with Knight Visuals. This deposit is applied to the total cost of the photography package selected.
• No date or time slot is reserved or confirmed until this deposit has been received.
• The deposit serves as a commitment from both parties and ensures Knight Visuals’ availability for the scheduled session or event.

Booking Deposit and Refund Policy:

1. A 70% booking deposit of the total session fee is required to secure your booking with Knight Visuals Photography Studio.
2. In the event of a cancellation by the client:
   • 50% of the booking deposit (equivalent to 35% of the total session fee) is refundable if the cancellation occurs at least 75hrs prior to the scheduled session.
   • The remaining 50% of the booking deposit is non-refundable, as it covers the studio’s administrative, preparation, and opportunity costs.
3. Cancellations made less than 72hrs before the session will result in the forfeiture of the entire 70% deposit.
4. In the event that Knight Visuals must cancel the session due to unforeseen circumstances, the client will be entitled to a full refund of the booking deposit or offered the option to reschedule at no additional cost.

2. Payment of Balance

• The remaining balance of the agreed-upon package must be paid no later than 24 hours before the scheduled shoot or event date, unless otherwise agreed in writing.
• Payments can be made via the accepted methods of payment listed below. No services will be rendered without full payment.
• Failure to pay the remaining balance within the specified timeframe will result in automatic cancellation of services, and the deposit will not be refunded.

3. Rescheduling Policy

• Clients may reschedule their session up to 72 hours prior to the scheduled time without penalty, subject to availability.
• Rescheduling requests within 72 hours of the scheduled shoot may be subject to an additional fee, depending on availability and any potential inconvenience caused.
• Knight Visuals will make every effort to accommodate rescheduling requests but cannot guarantee availability for the newly requested date or time.

4. Cancellations

• All cancellations must be submitted in writing, either via email or phone call.
• In the event of a cancellation, the Booking Deposit and Refund Policy outlined in Section 1 applies.
• If Knight Visuals cancels the session due to unforeseen circumstances (e.g., illness, emergencies, or equipment failure), the Client will be offered either a full refund or the option to reschedule the shoot at no additional cost.

5. Image Delivery & Turnaround Time

• Edited digital images will be delivered via an online gallery within 14-21 days following the shoot or event, unless a different timeframe is agreed upon in writing.
• The Client will receive access to high-resolution images suitable for digital use and printing.
• Should the Client wish to order additional items such as prints, photo albums, or additional editing, these services will incur extra fees.
• Rush delivery of images may be available upon request for an additional fee, subject to the photographer’s availability and workload.

6. Copyright & Image Usage Rights

• All images produced during the session remain the exclusive property of Knight Visuals.
• The Client is granted non-commercial, personal usage rights, allowing them to share and print images for personal use only (e.g., social media, family photo albums, etc.).
• Commercial usage (e.g., advertising, business promotion) requires a separate written agreement and may involve additional licensing fees.
• Unauthorized reproduction or use of the images for commercial purposes without express permission from Knight Visuals is prohibited and may result in legal action.

7. Model Release & Promotional Use

• By booking a photography session with Knight Visuals, the Client grants permission for images to be used by Knight Visuals for promotional purposes, including but not limited to:
  • Knight Visuals’ website
  • Portfolio
  • Social media platforms
  • Marketing materials
• If the Client does not wish for their images to be used for promotional purposes, this must be stated in writing prior to the session. Without this notification, Knight Visuals reserves the right to use the images for the purposes mentioned above.

8. Liability

• Knight Visuals will take all reasonable steps to ensure the safe and professional handling of the photography session, including the care of equipment and digital assets.
• Knight Visuals is not responsible for any unforeseen events, acts of nature, or situations outside their control (e.g., inclement weather, venue restrictions) that may affect the quality of the images or the ability to perform services.
• In the unlikely event of a total equipment failure or any other unforeseen circumstance that prevents the photographer from fulfilling the contract, Knight Visuals’ liability shall be limited to a full refund of all payments made, including the deposit.

9. Client Responsibilities

• The Client agrees to be on time for the scheduled session or event. Knight Visuals will not be held responsible for reduced coverage or images due to the late arrival of the Client or any participants.
• The Client agrees to adhere to any COVID-19 safety guidelines or other health and safety regulations that may be in place at the time of the shoot or event. These may include wearing masks, maintaining social distance, or following venue-specific rules.

10. Final Agreement

By making a booking with Knight Visuals Photography Studio, the Client acknowledges that they have read, understood, and agree to the terms and conditions outlined in this agreement.

This contract constitutes the entire agreement between Knight Visuals and the Client. Any modifications to this agreement must be made in writing and agreed upon by both parties.
